The Secretariat of Agriculture, Livestock and Fisheries today (27.05.2026) formalized Resolution 67/2026, which regulates in Argentina the procedure for the recognition and protection of Geographical Indications (GI) originating from the MERCOSUR Member States.
The measure represents a significant step in the implementation of the Agreement for the Mutual Protection of Geographical Indications Originating in the Territories of the MERCOSUR Member States, approved by Law 27.765, and establishes the administrative mechanism that will allow the evaluation in the country of GIs already recognized in Brazil, Paraguay and Uruguay.
Geographical Indications identify products whose quality, reputation, or other characteristics are associated with a specific geographical origin. In the agri-food sector, they constitute a strategic tool for commercial differentiation and regional enhancement.
Regulatory harmonization
The resolution stipulates that the National Directorate of Food and Regional Development will be responsible for carrying out the analysis and publication of the Geographical Indications (GIs) notified by the Member States. To this end, the corresponding lists and technical data sheets will be published in the Official Gazette and on the Alimentos Argentinos website.
Likewise, the regulation provides for the intervention of the National Institute of Industrial Property (INPI), which must issue a ruling regarding possible conflicts with registered trademarks and other restrictions provided for in Law 25.380 and in the regional agreement itself.
One of the key aspects of the measure is the opening of a 30-day period for legitimately interested third parties to submit substantiated objections. Among the grounds considered are the potential classification of the name as generic in Argentina, conflicts with pre-existing trademarks, similarities with other protected names, or possible risks of consumer confusion.
Value added
Once the advertising and technical analysis process is complete, the National Directorate of Food and Regional Development will prepare the corresponding opinion, which will be sent to the Ministry of Foreign Affairs for the continuation of the procedure within the MERCOSUR framework.
The regulations strengthen the regional scheme for protecting products with territorial identity and advance the harmonization of rules related to intellectual property, quality and agri-food trade within the bloc.
Furthermore, experts emphasize that this type of mechanism contributes to improving the international competitiveness of regional economies, promoting products with greater added value and recognition of origin in foreign markets.
The resolution also consolidates the Argentine regime of Geographical Indications and Designations of Origin provided for in Law 25.380, aligning it with the regional commitments assumed by the country in MERCOSUR.
