Exam closes

The Ministry of Economy, through the Resolution 172/2026, ordered the closure of the exam due to the expiration of the deadline and a change in circumstances. Antidumping measures applied to imports of aluminum foil originating in the People's Republic of China, rendering ineffective the measures that had been in force since 2020.

The decision has immediate application from its entry into force, that is, from February 23, 2026, the date of its publication in the Official Gazette.

The measure applies to unsupported, simply laminated aluminum sheets. classified under the tariff heading NCM 7607.11.90.

Background

The antidumping measures had been established by the Resolution 88 / 2020 of the then Ministry of Productive Development, which set a ad valorem antidumping duty of 28% on the FOB export value of a period of five years, maximum period provided for in the applicable regime and subject to renewal at the request of the national industry, provided that the conditions for its maintenance are proven.

As the expiration of the validity period approached, the review for expiration of term and change of circumstances provided for in the trade defense regulations was initiated.

Technical intervention

In this context, the National Commission for Foreign Trade The National Commission for Foreign Trade (CNCE), the competent technical body for assessing injury, analyzed the background of the case and issued its recommendation to the Undersecretariat of Foreign Trade. In its Act No. 2618, the body stated that “the antidumping measure under review had a significant impact on the market,” given that imports originating from China “were reduced to volumes far lower than those of the period prior to its application” and were “insubstantial in relation to apparent domestic consumption.”

The Commission also highlighted that the petitioning company increased its market share—from 64% in 2019 to 91% in 2024—and that the relative price of aluminum foil rose in a context where the international price of aluminum, its main input, fell. The Commission further emphasized the local producer's dominant market position and reiterated that trade defense measures are exceptional and must be evaluated considering their overall impact both within their own value chain and on the national economy as a whole, including their effect on consumer goods and the construction sector.

Based on the technical reports and administrative actions, the competent authority decided to close the examination and not extend the measure.

Consequently, imports of the investigated product originating in China cease to be subject to the additional antidumping duty and are only covered by the general tariff in force.

This falls within the framework of the trade defense regime, in which antidumping measures—the most widely used instrument globally—are temporary and based on Article VI of the GATT 1994 and the World Trade Organization's Antidumping Agreement. In this context, and once the review for expiration and change of circumstances provided for by current regulations was completed, the authority decided not to extend the measure, thus terminating its application.
