Customs adjusts export control of recovered waste

The General Directorate of Customs (DGA) published today (17.02.2025/XNUMX/XNUMX), the Resolution 9 / 2025, with the aim of adapting customs regulations to the provisions of Decree No. 1/2025, which regulates the export of recovered non-hazardous waste, that is, all non-hazardous waste that can be recycled or recovered, in whole or in part, to transform it into new materials.

The measure is based on Law No. 23.922, which approves the Basel Convention on the control of transboundary movements of hazardous wastes. According to its Annex IX, certain wastes are not considered hazardous, unless they contain Annex I materials in quantities that give them hazardous characteristics (Annex III) or are classified as hazardous by national regulations. It is also related to Law No. 24.051 and Decree No. 831/1993, which regulate hazardous waste and environmental protection.

New provisions

La Resolution 9 / 2025 introduces changes to customs controls for the export of ferrous and non-ferrous metals, removing restrictions established by previous regulations. Historically, these exports have been subject to strict controls. Through Decrees No. 1040/2020 and No. 70/2023, the Government had temporarily suspended the export of certain metal scrap to ensure the supply of local industry. However, the Decree No. 1/2025 It relaxes these restrictions by allowing the export of recovered waste that meets specific requirements.

As a result, Customs has revised its control guidelines, modifying the provisions of External Note No. 45/2008 (DGA), which established that these exports should be processed through the red selectivity channel or the red value channel. The controls established in External Note No. 84/2008 and its amendment, External Note No. 90/2008, which regulated the export of waste and scrap of steel, iron, copper, nickel and aluminum, have also been revised.

Expansion of authorized customs offices

Another relevant aspect of the resolution is the expansion of the customs offices authorized for the export operation of these valued wastes. The measure will allow more customs offices, under the jurisdiction of the General Subdirectorates of Metropolitan and Interior Customs Operations, participate in the process. With this initiative, Customs seeks to decentralize control and streamline the export procedures for such goods in different regions of the country.
